ICC Clears Rodrigo Duterte as Fit for Trial, Case to Move Forward

The International Criminal Court (ICC) has ruled that former Philippine president Rodrigo Duterte is mentally fit to take part in pre-trial proceedings, clearing the way for his long-delayed case to move ahead.

In a 25-page decision, ICC judges said Duterte can fully understand the charges, follow the evidence, and work with his legal team—meeting the legal standard required to proceed.

Medical Review Backs the Ruling

The decision was based largely on findings from an independent panel of three medical experts, covering forensic psychiatry, neuropsychology, and geriatric neurology.

While the experts noted some cognitive concerns, they unanimously agreed these do not prevent Duterte from meaningfully participating in the case. Judges stressed that having medical conditions does not automatically make someone unfit for trial—the key issue is whether they can engage with the process.

No More Delays

The case had been paused for months after Duterte’s defense asked for an indefinite suspension, citing alleged cognitive impairment. The ICC temporarily halted proceedings to allow medical examinations and submissions from all parties.

In its latest ruling, the court rejected further delays and declined to hold another evidentiary hearing, saying the expert reports were clear and reliable. Judges also approved limited medical accommodations during hearings to support Duterte’s participation.

What Happens Next

With the fitness issue settled, the ICC ordered the case to move forward. The confirmation of charges hearing will resume on February 23 at the court’s headquarters in The Hague. Judges will then decide whether prosecutors have enough evidence to send the case to full trial.
