ICC Opens Confirmation of Charges Hearing Against Rodrigo Duterte

The International Criminal Court (ICC) has officially begun the pre-trial confirmation of charges hearing against former Philippine president Rodrigo Duterte, highlighting accountability and justice for thousands of alleged victims of his government’s drug war.

Substantial Grounds for Crimes Against Humanity

Deputy Prosecutor Mame Mandiaye Niang told Pre-Trial Chamber I that there are “substantial grounds” to believe Duterte is responsible for 78 alleged murders and attempted murders.

“These crimes were part of a widespread and systematic attack on the civilian population,” Niang said, noting that Duterte’s role began as Davao City mayor and expanded nationwide as president.

The prosecutor described how Duterte allegedly oversaw and controlled what is known as the Davao Death Squad, personally directing killings and instructing subordinates to target suspected criminals, including drug users and dealers.

Evidence and “Common Plan”

Niang emphasized that the killings were not random. They followed a “common plan,” and witnesses testified that police acted under direct orders motivated by promises of rewards and immunity.

“Duterte intended and knew that the charged crimes were occurring,” Niang said, citing public statements, written orders, and his own admissions.

Victims Warn Against Duterte’s Return

Representing 497 authorized victims, lawyer Joel Butuyan warned the court that if the charges are not confirmed, Duterte could return to the Philippines “as a conquering hero,” reinforcing a culture of impunity and intimidating victims.

He urged judges to confirm the charges to allow witnesses to testify and evidence to be presented, arguing it is the only way to stop the spread of Duterte’s influence and ensure justice for those affected.

What the Hearing Means

The confirmation of charges hearing is a pre-trial process to determine if there is enough evidence to proceed. It is not a trial, but a key step to decide whether the case against Duterte will move forward in the ICC.

Duterte has denied wrongdoing and questioned the ICC’s jurisdiction, especially since the Philippines withdrew from the Rome Statute in 2019.
